Somebody is lying to us on Ballot Issue 1. It is either the trial lawyers or everyone else. We should not take anyone's word for this issue, including mine. We should do our own research and use facts, not legal double-talk.
Whenever over a half-million dollars has already been spent trying to persuade voters, we can likely get the answer simply by "following the money." This is relatively easy to do simply by looking at the contributors on the Ethics Commission website. Then click on "view local-option/ballot/legislative question committee filings." You can click on some filings such as: "Protect AR Families" or scroll most of the way down searching for "tort reform" in the right-hand column. Filings for every month for both sides of the issue are listed. Click on the date for the filing month you wish to examine and the entire document will appear. The contribution pages are typically near the end of the forms.
You will quickly discover that all of those typically posing as "grassroots" groups who oppose Issue 1 are lawyers, except for one notable exception, Family Council. However, once you see that their sole source of funds is from a personal injury attorney, you may be shocked, but you have your answer. When you check the contributors to these faux attorney groups from all across the country, you will discover that they are all lawyers (plus a handful who work for lawyers).
Conversely, those groups who support Issue 1 are comprised of chambers of commerce, health care professionals, small businesses, large corporations, banks, pharmacies, trucking companies, nursing homes, many individuals and groups who are often sued by "personal injury" attorneys. Large employers in our state.
One final note -- a retired judge (lawyer) filed a suit to prevent a vote by the people of Arkansas and has now received a ruling of being unconstitutional from a judge (lawyer) ordering that ballots for Issue 1 not be counted. Hey, that's what lawyers do. They file suits. Unfortunately, they also talk about citizen's rights whenever it helps lawyers, but don't hesitate to take away our right to vote on an issue that would hurt lawyers by decreasing their personal incomes. Maybe that's why their opponents are calling them "greedy lawyers," huh?
So, who is lying about Issue 1 and why? Perhaps, Issue 1 is good for everyone except trial lawyers.
