White considers private prosecution of Tett case

BUSINESSMAN Andrew White has said that he is now seriously considering a private prosecution of former assistant minister Betty Tett.

In Christmas 2014 Tett allegedly hired a hitman to kill him but the state has found insufficient evidence for prosecution.

White, his wife Joy Mboya and daughter have been seeking justice over the matter in vain.

However newly available telephone records show that Betty Tett and hitman John Linus Wachira exchanged 124 phone calls and messages between November and December 2014when businessman Andrew White was allegedly about to be assassinated.

However the CID did not include the telephone records in the file sent to the Director of Public Prosecutions Keriako Tobiko last year.

In August 2015 Tobiko stopped Betty Tett's prosecution for lack of evidence linking her to a plot to murder her business rival Andrew White. Yet telephone records indicate that she and Wachira called each other back and forth for several hours on 23 December, 2014 when Wachira was allegedly supposed to make the hit.

The DPP stopped Tett's prosecution after Wachira recanted his earlier statement implicating the former assistant minister.

Wachira and Tett continued their phone calls and messages on Christmas Eve andChristmas Day including a 12:58 pm SMS from Wachira to Tett "Tha XX man's name is Andrew".

White has claimed that the CID investigators failed to pass on this crucial information to the DPP leading to the decision to withdraw the case against Tett.

White has denied any out of court negotiations with Wachira, as alleged by some media reports. However, he says an investigating officer invited White and his wife to a meeting in a Lavington restaurant and offered him Sh20 million to drop the case but he declined.

Andrew White, his wife Joy and daughter Khadija White then curiously received summons issued on the public holiday of Mashujaa Day ( 20 October) to attend court the next day.

It has also emerged that her estranged son David Tett reported to police in September 2012that she had hired Wachira to poison him while both were in custody at the Industrial Area Remand Prison.

According to OB163/9/2012 at Industrial Area police station, David Tett reported that on20 July, 2012 John Wachira Linus went to his Block K and told him that he had been sent by Tett to kill him through poisoning. Both men were then on remand at Industrial Area prison, alleged that on July 20 2012 while at the Industrial Area Prison in Block K. Betty Tett is David's aunt.

David Tett reported that Sh 6,000 was sent by M-Pesa from number 0722 514876 allegedly registered to Betty Tett to 0171 663931 registered to Elias Linus. David then sought police assistance.

Tett allegedly fell out with White after he retired from Scanad advertising agency in 2013 and set up a TV and radio adverts production company.

Tett's production company Sounds and Pictures had previously been getting substantial business from Scanad to make TV and radio adverts.

Tett was on December 31, 2012 summoned and interviewed by CID at Kabete police station. She was summoned back again on January 5 but never showed up.

In his first statement, Wachira implicated Tett and alleged that she had paid him to kill White through several money transfers.

He allegedly went to White's home on December 24 to negotiate a payment not to kill him but did not find him and left a phone number.

On December 28, White promised that he would have Sh3 million the next day but instead reported the matter to Kabete CID, who laid an ambush and arrested Wachira as he was receiving the money at Safari Park Hotel.
